Terms of Service

These terms apply when you use RigYard ("we", "us"), including browsing, creating an account, listing a computer for sale, or contacting another member. Please read them carefully. By creating an account you agree to them.
1. Who we are

2. We're a venue, not a party to sales
RigYard is an online marketplace where people in the United Kingdom advertise computers and arrange sales directly with each other. We do not buy, sell, inspect, store, deliver or take payment for the items listed. Any contract for the sale of an item is between the buyer and the seller only. We are not responsible for the quality, safety, legality or description of items, the truth of listings, or whether a buyer or seller completes a sale.
Our only charges are the optional fees sellers pay to list or promote their items (see section 6). Buyers never pay us.
3. Your account
- You must be at least 18 and live in the UK to create an account.
- You must give accurate information and keep it up to date, including whether you sell as a private individual or as a business.
- Keep your password safe. You're responsible for activity on your account. Tell us straight away at safety@rigyard.example if you think someone else has access to it.
- One account per person. Don't create accounts to get around a suspension or our limits.
- You can delete your account at any time from your account settings.
4. Listing items
When you list an item you promise that:
- you own it or are authorised to sell it, and it isn't stolen, counterfeit or subject to finance you haven't paid off;
- the description, specifications, condition, photos and price are accurate and not misleading, and the photos are of the actual item;
- it complies with our Prohibited Items & Listing Policy;
- if you sell as a business, you've said so and you'll meet your legal obligations to consumers (see Seller Obligations).
You keep ownership of the content you post (text and photos). You give us a non-exclusive, royalty-free licence to host, display, resize and promote it on RigYard and in related marketing for as long as it's on the site, and for a reasonable period afterwards in backups and records.
5. Contacting other members
Use our messaging to arrange sales. Be honest and courteous, and follow our Community Guidelines. We may automatically check messages for signs of scams (such as requests for bank transfers or gift cards) and show safety warnings. We don't read your messages unless a conversation is reported to us or we need to investigate a breach of these terms or a legal issue.
6. Fees, promotions and refunds
Listing an item may cost a fee shown before you pay, and optional upgrades (such as featuring a listing) cost extra. Payments are taken by our payment provider, Stripe. Our Listing Fee & Refund Policy explains when fees are refunded, and your right to cancel. Business sellers can instead subscribe to a monthly plan that includes listing fees, as described in the same policy.
7. Safety
You're responsible for deciding whether to buy or sell, and for your own safety when meeting other members. Read our Stay Safe guide. Never pay by bank transfer for an item you haven't seen, and test a computer before you pay for it.
8. Moderation, suspension and termination
We may remove or refuse listings, messages or reviews, and warn, suspend or close accounts, if we reasonably believe they break these terms or the law, put others at risk, or harm the marketplace. We explain how we make these decisions, and how to appeal, in our Reporting & Content Moderation Policy. Fees aren't refunded when a listing is removed for breaking our rules. We may also stop offering RigYard, or any part of it, with reasonable notice.
9. Our responsibility to you
We provide RigYard with reasonable care and skill, but we can't promise it will always be available or free from errors. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited by law, including your statutory rights as a consumer.
Subject to that:
- we're not liable for the acts or omissions of other members, or for items bought or sold through RigYard;
- we're not liable for losses that weren't reasonably foreseeable, or for business losses (such as lost profit) if you use RigYard as a business;
- our total liability to you for any claim connected with RigYard is limited to the greater of £100 and the fees you paid us in the 12 months before the claim.
10. Your responsibility to us
If you break these terms or the law and that causes us loss (for example, a claim by another member or a regulator), you may be responsible for it, to the extent the law allows.
11. Changes to these terms
We may update these terms, for example to reflect new features or legal requirements. We'll tell you about important changes by email or on the site at least 30 days before they take effect, unless the change is needed sooner for legal or safety reasons.
12. Complaints, disputes and governing law
If you're unhappy with our service, contact support@rigyard.example and we'll try to resolve it. These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in your local courts.
